SOFTWARE LICENSE

1. GRANT OF LICENSE. grants you the right to use one copy of the enclosed software program, terse.com (the "SOFTWARE") on a single computer. You may NOT network the SOFTWARE or use it on more than one computer at the same time.

2. COPYRIGHT. The SOFTWARE is owned by and is protected by U.S. Copyright laws and international treaty provisions. You may make one copy of the SOFTWARE solely for backup purposes. You may NOT copy the accompanying manual, "The Programming Language."

3. OTHER RESTRICTIONS. You may NOT rent or lease the SOFTWARE, but you may transfer the SOFTWARE and the manual on a permanent basis provided you retain NO copies and the recipient agrees to the terms of this Agreement. You may NOT modify, reverse engineer, decompile, or disassemble the SOFTWARE.

LIMITED WARRANTY

• LIMITED WARRANTY. warrants that (a) the SOFTWARE will substantially perform in accordance with the manual; and (b) the diskette will be free from defects in material and workmanship under normal use and service for a period of ninety days from the date of receipt.

• CUSTOMER REMEDIES. 's entire liability and your exclusive remedy shall be, at 's option, either (a) return of the price paid or (b) replacement of the SOFTWARE that does not meet the Limited Warranty and which is returned to . This Limited Warranty is void if failure of the SOFTWARE or diskette has resulted from accident, abuse, or misapplication.

• NO OTHER WARRANTIES. disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the software and the manual. This limited warranty gives you specific legal rights, you may have others, which vary from state to state.

• NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall or 's suppliers be liable for any damages whatsoever (including without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use this product, even if has been advised of the possibility of such damages. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

• This Agreement is governed by the laws of the State of Florida.
